Article 2 — Purpose and scope
These general terms of sale govern all sales concluded on www.attolle.com between BME CONSULTING, hereafter “the Seller”, and any natural person not acting for business purposes, hereafter “the Customer”. Placing an order implies unreserved acceptance of these terms.
Article 3 — Products
The essential characteristics of each product appear on its page. Photographs are as faithful as possible but are not a contractual document. EU Declarations of Conformity are available on request at contact@attolle.com; the real state of the documents we hold, including those we are still waiting for, is published on the Our checks page.
Portable air conditioners fall under Regulation (EU) 626/2011 on energy labelling. The corresponding energy label and product fiche are published on each reference's page as soon as it is registered in the EPREL database; where that registration is under way, the product page says so expressly rather than staying silent.
Article 4 — Prices
Prices are shown in euros inclusive of all taxes, excluding delivery charges. The Seller reserves the right to change its prices at any time; products are invoiced at the price in force when the order is confirmed.
Where an eco-contribution is payable under extended producer responsibility rules, its amount is shown on the product page and carried into the cart.
Article 5 — Orders
The Customer selects their products, checks the details of their order, corrects it where necessary, then confirms it. That confirmation constitutes acceptance of the prices, the products and these terms. The contract is formed on the order confirmation sent by email.
Article 6 — Payment
Payment is due when the order is placed. The accepted means of payment are shown in the cart before the order is finally confirmed. Payment data never passes through the Seller's servers and is not kept by the Seller.
Article 7 — Delivery
Delivery areas, lead times, charges and terms are set out in the shipping policy, which forms an integral part of these terms.
Products are currently shipped from China. For deliveries within the European Union, customs duty and import VAT are paid by the Seller: the price shown is the final price and no additional charge is asked of the Customer on delivery.
The risk of loss or damage passes to the Customer when they, or a third party designated by them other than the carrier, takes physical possession of the product.
Article 8 — Right of withdrawal
In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has fourteen calendar days from the day after receipt of the product to exercise their right of withdrawal, without having to justify their decision. Full terms, model form and estimated return cost: Returns and withdrawal. Returns go to our address in France.
Article 9 — Statutory warranties
All products carry the statutory warranty of conformity (articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code), independently of any commercial warranty.
Under the statutory warranty of conformity, the Customer has two years from delivery of the goods to bring a claim. They may choose between repair and replacement of the goods, subject to the cost conditions set out in article L.217-12 of the French Consumer Code. They are not required to prove the lack of conformity during the twenty-four months following delivery. Bringing the goods into conformity is done at no cost to the Customer.
Under the warranty against hidden defects, the Customer may bring a claim within two years of discovering the defect and obtain a refund of the price against return of the goods, or a reduction in the price.
These warranties apply independently of the commercial warranty mentioned in article 10 and are in no way restricted by it.
Article 10 — Commercial warranty and after-sales support
The two years of warranty announced by Attolle correspond to the statutory warranty of conformity, which we apply at no cost to the Customer: return, repair or replacement, and reshipment are all on us. After-sales support is handled in France. How it works and what is excluded: Warranty and support.
Article 11 — Spare parts
In accordance with article L.111-4 of the French Consumer Code, the period during which the spare parts essential to using each product will be available is stated on its product page. Where that information has not been given to us by the manufacturer, the product page says so expressly.
Article 12 — Personal data
See the privacy policy.
Article 13 — Complaints and mediation
Any complaint may be sent to contact@attolle.com. Failing an amicable solution, the Customer may refer the matter free of charge to the CM2C mediator: Consumer mediation.
Article 14 — Governing law
These terms are governed by French law. Consumers also benefit from any mandatory protective provisions applicable in their country of residence.
