WEBSITE TERMS OF USE

These terms govern access to and use of the site. They are separate from the terms and conditions of sale, which govern orders.

Article 1 — Site publisher

The site www.attolle.com, hereinafter the “Site”, is published and operated by:

Article 2 — Purpose

These terms set out how the Site may be accessed and used. They do not replace the terms and conditions of sale, which apply to all orders placed on the Site.

The rules on the processing of personal data are set out in the privacy policy. Returns, refunds and deliveries are covered by the corresponding policies, all accessible from the footer.

By accessing the Site or using its features, the user acknowledges having read these terms.

Article 3 — Access to the Site

Access to the Site is in principle free of charge, excluding the cost of the internet connection and of the equipment required, which remain the user's responsibility.

BME CONSULTING endeavours to keep the Site accessible and working. Access may nevertheless be temporarily interrupted, in particular for maintenance, updates, technical failure, a problem affecting Shopify or another provider, a security incident, force majeure, or any event reasonably beyond our control.

BME CONSULTING does not guarantee permanent, uninterrupted availability of the Site. Temporary interruptions give no right to compensation, except where a mandatory legal provision states otherwise.

Article 4 — Customer account

Some features may require a customer account. The user undertakes to provide accurate, complete and up-to-date information. The user is responsible for keeping login details confidential and must take all reasonable precautions to prevent unauthorised access to the account.

The user must promptly inform BME CONSULTING at contact@attolle.com on noticing any fraudulent or unauthorised use of their account.

BME CONSULTING may temporarily suspend an account where fraudulent activity, a security breach or a breach of these terms is reasonably suspected. Such suspension does not limit the customer's rights in respect of orders already concluded.

Article 5 — Prohibited uses

The user undertakes to use the Site fairly, lawfully and for its intended purpose. In particular, it is prohibited to:

  • use the Site for fraudulent or unlawful purposes;
  • provide false information or impersonate a third party;
  • attempt to gain unauthorised access to the Site, to an account or to a computer system;
  • disrupt the operation or security of the Site;
  • introduce a virus, malware or any other harmful code;
  • circumvent security or access control measures;
  • unlawfully collect personal data;
  • use the Site to send unsolicited communications;
  • reproduce or extract the Site's content on a large scale without authorisation;
  • use automated tools in a way likely to disrupt the normal operation of the Site;
  • infringe the rights of BME CONSULTING, of Shopify or of a third party.

BME CONSULTING may take the technical measures reasonably necessary to protect the Site and its users.

Article 6 — Product information

BME CONSULTING endeavours to provide accurate and up-to-date information about the products presented on the Site. The contractual characteristics of the products are those appearing on the product page and in the order confirmation at the time of purchase.

Photographs, videos, illustrations and staged images are illustrative. Differences due to the screen used, to lighting, to perspective or to the environment photographed do not necessarily amount to a difference affecting the essential characteristics of the product.

Runtimes, output and areas covered. The runtimes, areas covered and recharge times shown on the Site correspond to test conditions stated on each product page. Actual performance varies with ambient temperature, insulation of the space, the power of the appliances connected, and the state of charge and age of the battery. These values are indicative and are not a guarantee of result.

Safety and installation. General information on installation, electrical connection, hot-air venting, handling lithium batteries, safety or maintenance is provided for information. It in no way replaces the manufacturer's manual, the applicable official texts, or a competent professional.

Compliance documents. The EU Declarations of Conformity, test reports and energy labels made available for download are those supplied by the manufacturers. They are provided for information and traceability.

Article 7 — Intellectual property

The structure of the Site and its content — in particular trade marks, logos, trade names, texts, photographs, videos, illustrations, manuals, graphics, visual elements and downloadable documents — are protected by intellectual property law.

These elements belong to BME CONSULTING, to its licensors or to their respective owners. Access to the Site grants the user no ownership rights over this content.

Any reproduction, representation, adaptation, extraction, distribution or exploitation, in whole or in part, carried out without authorisation is prohibited, save where the law expressly provides otherwise. Users may view and print content for personal, non-commercial use.

Article 8 — Reviews and user content

The Site currently displays no customer reviews. The rules below will apply as soon as that feature is opened, and the arrangements for checking and publishing reviews will then be set out on this page in accordance with Articles L.111-7-2 et seq. of the French Consumer Code.

Where a user publishes a review, a photograph, a video or other content on the Site, they warrant that:

  • they are the author of the content or hold the necessary permissions;
  • the content is genuine and reflects a real experience;
  • the content does not infringe the rights of a third party;
  • the content includes nothing unlawful, insulting, defamatory, misleading or discriminatory.

BME CONSULTING may moderate or remove content that is manifestly unlawful, fraudulent, unrelated to the product, infringing, or damaging to the rights of a third party.

Where a user voluntarily publishes a review intended to be public, they authorise BME CONSULTING to display it on the Site for as long as is reasonably necessary to present customer reviews. Any use of a photograph identifying a person in an advertisement or on social media will require separate authorisation.

A review is not removed solely because it expresses a negative opinion, provided it complies with the rules above.

Article 9 — Links to third-party sites

The Site may contain links to sites, platforms or services operated by third parties. BME CONSULTING does not continuously monitor those services and is not responsible for their content, availability or practices. The presence of a link does not necessarily mean that BME CONSULTING approves or recommends the site concerned.

Article 10 — Shopify and technical services

The Site uses the Shopify e-commerce platform, which provides the technical infrastructure allowing products to be displayed, the basket to be managed, accounts to be created and orders to be placed.

Sales are nevertheless concluded directly between the customer and BME CONSULTING. Shopify is not the seller of the products offered by Attolle.

Some features may be supplied by third-party providers. Their use may be subject to their own terms, presented to the user where necessary.

Article 11 — Personal data and cookies

Personal data collected while using the Site is processed in accordance with the privacy policy. Cookies that are not strictly necessary are placed only after the user consents; how to withdraw that consent is set out in the cookie policy. Requests relating to personal data can be sent to contact@attolle.com.

Article 12 — Liability

BME CONSULTING is liable for direct damage resulting from a failure attributable to it, under the conditions laid down by law.

BME CONSULTING cannot be held liable for damage resulting solely from use of the Site contrary to these terms, from the user's own fault, from the unforeseeable and insurmountable act of a third party, from an event of force majeure, or from an interruption beyond its control, subject to applicable legal obligations.

Nothing in these terms limits or excludes consumers' mandatory rights or liability that cannot lawfully be excluded. Terms relating to liability for products, orders, deliveries and guarantees are set out in the terms and conditions of sale.

Article 13 — Reporting content or a problem

Any misuse, security flaw, infringement of intellectual property rights or manifestly unlawful content can be reported to contact@attolle.com. The report should contain enough information to identify the content or problem concerned.

Article 14 — Changes to these terms

BME CONSULTING may amend these terms to reflect changes in the Site, in its features or in the applicable rules. The version that applies is the one published on the Site at the time of use.

Changes do not apply retroactively to orders already concluded, which remain subject to the terms and conditions of sale accepted when they were confirmed.

Article 15 — Governing law

These terms are governed by French law. This does not deprive a consumer residing in another European Union State of any more protective mandatory provisions applicable in their country of residence.

Any dispute concerning an order is handled in accordance with the provisions on dispute resolution and mediation set out in the terms and conditions of sale.
